1. Acceptance of Terms
By registering, accessing, or using SME SalesTeam, you agree to comply with these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. Continued use of the Platform after any changes signifies your acceptance of the revised Terms.
2. User Accounts
- Account Creation: To use certain features of SME SalesTeam, you must create an account and provide accurate information, including contact details and valid identification.
- Eligibility: You must be at least 18 years of age and legally able to enter into binding contracts.
- Account Security: You are responsible for maintaining the confidentiality of your login information and for all activities under your account. Notify us immediately of any unauthorized access.
3. Service Overview
SME SalesTeam provides a platform where clients ("Clients") can post sales-related projects and freelancers ("Freelancers") can offer their services. We facilitate connections but are not a party to any contracts between Clients and Freelancers.
4. User Responsibilities
- Clients: You are responsible for clearly outlining project requirements, compensating Freelancers as agreed, and adhering to these Terms and all applicable laws.
- Freelancers: You agree to provide services professionally, meet deadlines, and respect Client confidentiality. All work delivered must be original and free of intellectual property infringement.
5. Payment Terms
- Fees: SME SalesTeam may charge fees for certain services. You agree to pay all applicable fees per the Platform’s pricing structure.
- Payment Process: Payments between Clients and Freelancers are facilitated through the Platform’s secure payment system. Funds will be released to Freelancers upon Client approval of work completion.
- Disputes: In the event of a payment dispute, SME SalesTeam will attempt to mediate; however, we are not liable for unresolved disputes.
6. Prohibited Conduct
Users agree not to:
- Use the Platform for any illegal or unauthorized purpose.
- Impersonate another person or misrepresent your identity.
- Post false, misleading, or defamatory content.
- Circumvent or attempt to bypass the Platform’s payment or messaging system.
7. Intellectual Property
- User Content: Users retain ownership of the content they create. By posting on SME SalesTeam, you grant us a non-exclusive license to display, reproduce, and distribute your content on the Platform.
- Platform Content: All content and materials provided by SME SalesTeam (e.g., text, graphics, logos) are our intellectual property and may not be used without our express permission.
8. Disclaimers
- SME SalesTeam is not responsible for the quality, accuracy, or legality of the work delivered by Freelancers or the actions of Clients. All interactions and transactions are at the user’s own risk.
- We do not guarantee continuous, uninterrupted access to the Platform. Maintenance, updates, or issues beyond our control may affect availability.
9. Limitation of Liability
To the fullest extent permitted by law, SME SalesTeam, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruptions.
10. Indemnification
You agree to indemnify and hold harmless SME SalesTeam from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from your use of the Platform, your violation of these Terms, or any infringement of intellectual property or other rights.
11. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Canada. Any disputes arising from these Terms or use of the Platform will be subject to the exclusive jurisdiction of the courts located in Canada.
12. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct. Upon termination, you lose the right to access and use the Platform.
13. Amendments to Terms
SME SalesTeam may amend these Terms from time to time. We will provide notice of significant changes by posting updates on our website or sending an email notification. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
